Court Paves Way For UK-Based Cleric’s Extradition To U.S.

The European Court of Human Rights gave final approval on Monday for the extradition of one of Britain’s most radical Islamist clerics and four others to the United States, where they face terrorism charges.

The decision caps a long legal battle and means Abu Hamza al-Masri could be extradited within weeks. Britain’s Home Office, or interior ministry, said it would hand over the suspects “as quickly as possible”.

The Egyptian-born al-Masri, 54, filed an appeal, along with the four other suspects, after the court in Strasbourg authorized Britain to transfer him to the United States on charges he supported al Qaeda and aided a fatal kidnapping in Yemen. Al-Masri, who could face a sentence of more than 100 years in an ultra-secure “Supermax” prison, had argued such treatment would contravene Article 3 of the European Convention on Human Rights, which prohibits inhumane and degrading treatment.

“Today the Grand Chamber decided to reject the request. This means that the Chamber judgment of April 10, 2012, is now final,” the court said in a statement. The decision also concerned appeals lodged by four other defendants, Babar Ahmad, Syed Tahla Ahsan, Adel Abdul Bary and Khaled Al-Fawwaz, all of whom have been detained in Britain pending extradition to the United States. A Home Office spokesman said: “We will work to ensure that the individuals are handed over to the U.S. authorities as quickly as possible.”

The family of Ahmad called on the government to halt the extradition process, saying British prosecutors were in possession of the material that forms the basis of the U.S. indictment and should pursue the case in Britain. Al-Masri is one of the most radical Islamists in Britain, a country he has attacked for its support of U.S.-led wars in Iraq and Afghanistan.

President Omar Hassan al-Bashir said on Saturday Sudan’s next constitution would be “100 percent Islamic” to set an example for neighbouring countries, some of which have seen religious parties gain power after popular uprisings.

 

 

The secession of mostly non-Muslim South Sudan a year ago sparked predictions that Sudan, which hosted former al Qaeda leader Osama bin Laden in the 1990s, would start implementing Islamic law more strictly.

In a speech to leaders of the mystical Islamic Sufi tradition in Khartoum, Bashir suggested Sudan’s new, post-secession constitution could help guide the region’s political transformation.

The following essay was originally planned to discuss war under the law of Islam. With four schools of Sunni Islamic law, and then another four Shiite schools of law, it is a very complex topic. An entire book could be written about it. I don’t pretend to be a scholar on this subject, but it is still important to discuss, in summary, the motivation for Islamic war against the infidel.

In the mindset of the fundamentalist jihadi, holy war against the non-believer is a religious duty because of the universalism of his mission, which is to convert non-believers to Islam by force or persuasion. For the Islamist, persuasion is always the first choice, but if not then force becomes necessary.^[1]

Jihad is in fact regarded as a form of religious propaganda that is carried on by either persuasion or the sword, but jihad does not always mean war, since exertion in the path of Allah might come through peaceful means, as in the case of Indonesia. Muhammad warned his people against the sins of idolatry and invited them to worship Allah. “He who exerts himself (jihada) exerts only for his own soul, which expresses the Jihad in the terms of salvation of the soul rather than for Proselytization.”^[2]

The Koran says:

“9.25 — But when the forbidden months are past, then fight and slay the pagans wherever ye find them, And seize them, beleaguer them, and lie in wait for them in every stratagem (of war); but if they repent (accept Islam) and establish regular charity then open the way for them; for God is forgiving, most merciful.”^[3]

Within the Muslim community or Ummah, legal war or jihad is an obligation or social duty (Fard Kifaya) There can be exemptions; when one group of Muslims carry out their duty out then it offers others exemption. ^[4] Exemptions also include: sickness, extreme youth, insanity, blindness, lameness, sex (females), the inability to obtain what is needed to participate and being in a state of servitude.^[5]

Turkey’s Arab Spring is happening so quietly no one has taken note.  There appears to be a hardliner Islamist coup happening inside of the Islam leaning AKP party.   Now the late July 2011 AKP arrests of Turkish military officers is now looking like a staged event to clear the decks for a hardliner takeover.

It all started when,  Turkey’s top four military leaders resigned after 250+ officers accused of plotting a coup were arrested.  The collective “early retirement” of the top four came hours after a Turkish court charged 22 suspects, including several generals and officers, with carrying out an internet campaign aimed at undermining Erdogan’s Justice and Development party (AKP) government.

A would-be teen beauty queen was stoned to death after her participation in a Ukranian pageant reportedly infuriated local Muslim youths.

Katya Koren, 19, was targeted by three fellow teens who said her seventh-place finish in the beauty contest was a violation of Muslim laws, according to British newspaper reports.

One of the suspects, identified as 16-year-old Bihal Gaziev, told authorities that he had no regrets about the stoning because the dark-haired Koren “violated the laws of Sharia.”

The teen’s battered body was found buried in the forest near her village in the Crimea section of the Ukraine. She had disappeared a week earlier. (More Below)
